Brown box packaging and 90 day Sandisk warranty. Sounds like refurbs or offline repaired to me.
It’s possible they’re repackaged NOS (“New Old Stock”, never-used items that have just been sitting on the warehouse shelf for a long time).

How is brown box new? Only 90 day warranty? It sounds like it is probably a refurb. A new 8 GB Fuze for $45 shipped sounds too good to believe. It is $61.54 on Amazon with free shipping.
