Brand new card error

I have just bought a brand new 32GB micro SDHC card and all my camera show a 'Card error' message when I first tried to use it. My computer doesn't even recognize it. It looks like it is a factory defect. And yes, I tried formatting it on my camera, but it didn't work. Also, it is not on locked position.

Can I fix it? Or how can I get it replaced? The problem is that I lost the contact with the seller
