Welcome to forums.sandisk.com (the “Forums” or “Site”). This Forums is owned and operated by Western Digital Technologies, Inc. (collectively, “WDT”, “we”, “our” or “us”) to provide information about SanDisk^® brand products and services. The terms “you”, “your” and “yours” refer to anyone accessing, viewing, browsing, visiting or using the Forums.

The following are terms and conditions constitute a legally binding contract between you and WDT which govern your use of the Forums. By registering, accessing, and/or using the Forums, you represent and warrant that you are at least 18 years of age and have the requisite power and authority or any and all permissions necessary to enter into and be bound by this agreement and you acknowledge that you have read, understood, and agree, to be bound by these terms and to comply with all applicable laws and regulations, including U.S. export and re-export control laws and regulations. The Forums currently are provided as a free service to users who agree to abide by this Agreement. WDT reserves the right to change the nature of this relationship at any time.

FORUMS RULES
You are entirely responsible and liable for all activities conducted by you. The Forums site areas are not to be used for commercial purposes unless sanctioned by the Forums group administrator. Listed below are some, though not all, violations that may result in WDT terminating your access. You agree not to do any of the following actions while using Forums:
(1) Harass, threaten, embarrass, or cause distress or discomfort upon another participant, user, or other individual or entity;
(2) Transmit via Forums any information, data, text, files, links, software, chat, communication or other materials ("Content") that WDT considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, racially, ethnically or otherwise objectionable;
(3) Impersonate in the Forums any person, including but not limited to, an official, WDT forum administrator, moderator, guide, host or forum member;

(6) Intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to any regulations having the force of law while using or accessing the Forums or in connection with your use of the Forums in any manner;
(7) Invade the privacy or violate any personal or proprietary right of any person or entity; and
(8) Infringe the intellectual property rights or similar rights, including but not limited to copyrights and trademarks, of any person or entity.

CONTENT YOU PROVIDE
You grant to WDT the right to publish and use any material you post on the Forums. You and any user of your User Name must evaluate, and bear the risk associated with, the accuracy, completeness, or usefulness of any Content. WDT generally does not pre-screen, verify or edit the content posted by users in the Forums. WDT shall have the right, but not the responsibility, to remove Content that is deemed in its sole discretion harmful, offensive, or otherwise in violation of this Agreement or any rules in place at the time without providing notification. WDT shall also have the right to reclaim any usernames on behalf of any businesses or individuals that own trademark or legal right on those usernames. WDT may elect at its sole discretion to monitor some, all, or no areas of Forums for adherence to this Agreement or other posted rules and guidelines. The Forums contain tools that allow you to communicate with other users and to share these conversations. By posting, uploading or otherwise making available Content on the Forums, you acknowledge that other users of the Forums may use or share your Content. WDT is not responsible for enforcing any rights you may have with respect to your Content against other users. You are responsible for the Content you provide; you should not have any expectation of privacy in the Content you provide on the Forums.

Although the Forums are moderated by WDT employees; it is intended only as a way for visitors to get answers from other visitors, and not to get answers from WDT. Submission of Unsolicited Ideas
It is our standard corporate practice that confidential or proprietary information from you not be submitted through the Forums or by email. Neither SanDisk, nor its officers, directors, employees, agents, successors, distributors or affiliates is responsible or liable for any loss, damage (including, but not limited to, actual, consequential, or punitive), liability, claim, or other injury or cause related to or resulting from any information posted on the SanDisk Forums.

TERMINATION:
SanDisk may, in its sole discretion, terminate or suspend your access to all or part of the SanDisk Forums for any reason, including without limitation, breach of this Agreement. In the event this Agreement is terminated, the restrictions regarding Materials appearing on the site, and the representations and warranties, indemnities and limitations of liabilities set forth in this Agreement will survive termination. In the event that you are unsatisfied with the services provided by SanDisk, your sole remedy is to terminate this Agreement.

JURISDICTION:
The SanDisk Forums are controlled and operated by SanDisk from SanDisk headquarters. The SanDisk does not represent or warrant that Materials on the site are appropriate or available for use in other locations. If you choose to access the SanDisk Forums from other locations, you do so at your own risk and are responsible for compliance with any and all local laws. This Agreement will be governed by and construed in accordance with the laws of the State or California, exclusive of conflicts of law principles. Any action brought to enforce this Agreement or matters related to the SanDisk Forums must be brought in either the State or Federal Courts of the California. If any provision of this Agreement is deemed void, unlawful, or otherwise unenforceable for any reason, that provision will be severed from this Agreement and the remaining provisions of this Agreement will remain in force. This Agreement constitutes the entire agreement between you and SanDisk concerning your use of the SanDisk Forums, and the Agreement will not be modified, except in writing, signed by both parties.
